Terms of Use

These terms are an agreement between you and NewCulture Consulting, LLC (“we”). They cover the Should I Fish? website (shouldifish.app) and the Should I Fish? iOS and Android app (together, the “Service”). By using the Service you agree to them. If you don’t, please don’t use it.

What the Service is

Should I Fish? computes a fishability score from public tide predictions, weather forecasts, and sun and moon positions. The score is a model. It is not a promise that fish will bite, and it is not a safety assessment. Tide and weather inputs come from third parties (NOAA CO-OPS and Open-Meteo) and can be wrong, late, or missing. Town tide times are estimated offsets from the nearest NOAA station.

Your safety is your call. The Service may flag rough conditions, but a missing warning does not mean conditions are safe. Check official marine forecasts and use your own judgment before going on or near the water.

Free and Pro

The website and the app are free to use, with today’s forecast plus the next three days for one location. Pro, sold only inside the app, adds the full seven-day forecast, up to eight followed locations, saved days with reminders, and catch-log pattern insights. The exact features of each tier are listed on the app’s upgrade screen and may change over time.

Purchases

• Pro is sold as in-app purchases through Apple’s App Store or Google Play. Prices are shown in the store at the time of purchase and may vary by region.
• Trip Pass (3 days) and Month Pass (30 days) are one-time purchases. They do not renew. Pro ends when the pass expires.
• Year is an auto-renewing subscription. It renews annually at the then-current price until you cancel it in your App Store or Google Play account settings, at least 24 hours before the renewal date. Cancelling stops future renewals; it does not refund the current period.
• Refunds are handled by Apple or Google under their policies. We cannot issue store refunds ourselves.
• Purchases are tied to your store account and can be restored on another device with “Restore purchases.”

Your content

Catch log entries, saved days, and locations are stored on your device and belong to you. We do not upload them. Because they live only on your phone, deleting the app deletes them, and we cannot recover them.

Acceptable use

Don’t scrape, bulk-download, or resell the Service’s forecast data or interfere with its operation. NOAA and Open-Meteo data are subject to their own terms. The fishability score, the site, and the app are ours; you may use them for personal, non-commercial fishing planning.

No warranty

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and uninterrupted availability. Forecasts can be wrong. Data feeds can go down.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss, injury, or damage arising from your decision to fish, boat, or otherwise act on the Service’s output. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

Changes and termination

We may change the Service or these terms. Material changes to the terms will show a new date at the top of this page. We may suspend access for abuse. You can stop using the Service at any time; delete the app to remove its data.

Governing law

These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.
